The title says it all. I have a 9 year old brittany spaniel, Jake. He lives with my parents (who i live with three months out of the year). Because they live on a golf course, there are no fences in the yards. They could get one put in but its very expensive (only rot iron is allowed). Jake is completely trained to stay in the backyard only and my mom is always with him.
Today, they were outside and a man walking his dog came over into our yard. He called Jake over to him, so my mom started walking over to say hello, following Jake (in our yard). Well the dog attacked Jake!! My mom freaked out and Jake was wimpering (he didnt fit back). My mom yelled at this man, tended to Jake, brought him inside, grabbed the camera and snapped several pictures of the man and his dog. She called the animal police and guess what they said! They can’t do anything because Jake wasn’t on a leash! IN HIS OWN YARD.
Needless to say my mom was furious and printed out signs to put up all over the neighborhood (just the dog, not the man’s picture) warning that the dog was vicious.
Jake is at the vet for the night and we don’t know the extent of his injuries.
I AM FURIOUS.

I’m furious and saddened reading this!! Poor doggie, if that happened to my dogs I would explode too. How stupid that man for not controlling his dog!! What did he say? Did he even say sorry??? Or offered to pay for Jake’s injuries? Gosh, I just don’t get people’s behavior sometimes.
Hope he feels better soon lots of good vibes for you and your mommy too!

Oh no! What on earth made him think going into another persons yard and calling another persons dog over to him would be a good idea? What an idiot! And then just walking away! *shakes stick at evil man*

People are getting scarier every day. I hope Jake recovers fully and quickly!
That is so horrible! Isn’t the guy who came onto your property in the wrong?!? I don’t understand! You should lie and say you have an invisifence. That is essentially a leash of sorts as your dog would be considered contained.
I’m absolutely furious!! FURIOUS!!
Can you phone the police and try to press charges for tresspassing?
Or I’d try one of those lawyers (you know the ones you don’t have to pay unless you sue and win) and just phone them and see if they have any idea of what you could do.

Jake just got back from the vet- he has no long term injuries. a few puncture wounds but no broken bones or anything.
He did not say sorry or offer to pay for anything. Apparently my mom screamed at him and he just walked away. I don’t believe he said anything. I asked my mom if he may have been mentally challenged and she said that he seemed perfectly normal. He wouldn’t give her his name or anything like that (hence her taking pictures).
He did come into our yard. He was in our backyard.
My mom has never seen the man or dog before. We’ve lived in this neighborhood for about a year and a half.
My mom also called the police and they sided with animal control.
She is definitely looking to our legal rights- the fact that this is totally legal is so infuriating!!!!!!!! She’s also taking bids to get a fence built. We can’t really afford it right now but she is so shaken up about it (understandably I think!!).
It makes me wonder about the man’s sanity. He may be one of those serial-killers-in-the-making. That he may have wanted his dog to attack Jake for entertainment or whatever reasons. My parents are going to hunt him down, though. My mom reported the dog to the golf course that we live on and to the homeowner’s association.
I hope we find him!!

It’s not legal it’s tresspassing. As well, depending on where you live, he’s liable for all the vet bills.
I think the posters are a great idea-talking to neighbors etc. Hopefully you can get his name.

a few puncture wounds
Just something I just learned-you cannot put neosporin or polysporin on punctures because the petroleum can get under the skin (not cause an infection) but the body cant’ get it out. A vet told me this-but Katnip may have more insignt if that’s true or not. Also I’m sure your vet told you what to do, but if he didn’t mention ‘use it’ or ‘don’t use it’ I’d opt for not

Katie where do you live? Because I’m thinking a call/email to the newspaper or other media might be in order. If this guy is a little off and was wanting to start something then he might do the same to other people as well, and the fact that the police and animal services aren’t willing to do anything right now might change if there’s a little media pressure on them.

The reason the police sided with AC is because usually AC is a division of law enforcement.
Unfortunately, in most places, unless a dog is contained by a fence he is required to be leashed, even in his own yard. Because the man’s dog was leashed and yours was not the powers that be will automatically blame the owners of the unleashed dog. If he had been leashed the man would not have been able to call him over. Not fair but that’s the way it is in most places.
I’m very sorry your dog got hurt. I hope he heals up fast.
Poor Jake! Glad he is not hurt badly. That is crazy that someone would come into your yard with a strange dog! I would hunt him down and hand him the vet bill!! I wish your parents good luck with this.

I had a similar situation happen to me and Teddy over the summer. We were walking on the sidewalk, on the OTHER side of the street, in front of someone’s house. There were two kids/teenagers outside in the yard with a dalmation who supposedly had an electric fence, at least he was wearing the collar. The horny teens were too busy flirting with each other to notice that this stupid dog came charging out of his yard, crossed the street, and started attacking Teddy! I had Teddy on a leash – we were on a walk, after all – and so I was caught in the middle of it – So scary! I thought I was going to get bitten. The dogs were barking at each other – well, the dalmation was barking, Teddy was wimpering and trying to get away – and I was yelling at the dumba**es across the street to call their dumb dog… they didn’t even bother to come get the dog. I finally detached the dog from Teddy and got the heck outta there as fast as possible! Luckily, nothing happened to Teddy or me, but I took Teddy home and went back to the house and told the lady who answered the door about what had happened and got her name, phone number and address in case something did turn out to be wrong w Teddy because of the attack. At least she was apologetic, but I don’t think she really believed me. Grrr. Just thinking about this is making me even more mad!
I’m sorry that all that happened. I would think that you have grounds to sue, since your dog was injured and that guy WAS trespassing. Good luck getting justice! I think sending a story to the newspaper is a good idea. Is there a community newsletter that you could submit the story to too?

in Texas, we don’t have to have Jake leashed as long as he is in our property (legally). This is because of cattle dogs, ranch dogs, etc can be free roam as long as they are on their owners property.
I’ll suggest calling the local news to my mom- i didn’t even think of that. we have a really intense local news station that would probably eat this up in a heart beat. I will also recommend that she push the trespassing as opposed to the attack since that seems to be where the law is clearest.
oh and I didn’t ask my mom what the vet said about medicine- i was in class when she left a message

aw you guys are too sweet. yes jake has been doing well! he seems to be healing nicely- he does pee a LOT more on the perimeter of the yard. I think he’s wary of anyone else intruding!!
i went home a couple weeks ago and saw him- he’s looking great. old, but great! we upped his arthritis meds so that is also helping. i can’t wait to go home next week for christmas and see his little face!
did your mom find the guy? i cant belive that happend!! something like that happend to my friend.. except his cat was on a leash outside and some guy walked by with a dog and the dog attacked the cat.. the cat won.. it was obviouse.. since the guys dog was soo beat up nobody decided to change cuz the vet bill would be enough punishment

Yes leash laws are a funny thing. If the man knew his dog was a fighter why did he call Jake to him. That is if he knew
When I had the 2 dogs when I would walk them I carried a big stick. I had to use it 3x in all the years 7 I think that I walked them.

Aww Im so sorry about this Katie, to tell you the truth our dogs are fighters too, they snap whenever another dog comes near! It is probably because one of them is a terrier and the other is half terrier, terriers are fiesty! But Luckily our dogs are small so they can never really do too much damage and we always try to keep them away from other dogs. One time these two dogs ran up to me and I had to pick our terrier up because I knew there would be a fight if I did not, but it was kind of amusing because he kept snarling at the dogs while he was in my arms.
Thank goodness he healed up alright without too much trouble. Also looking fwd to pics.
Yes 1 of the times I was walking my pair and a dog got out of the fence and came charging in attack posture at Odie. Just b4 the dog reached Odie and Spar like 2 ft away I took that stick and cracked it down as hard as I could. Broke the stick over the dogs head. Was a big broom stick without the broom.
I was across the street from where it lived when it charged.
2nd time a lady got home w/groceries and her daughter left the house door open. Out charges her dog I didn’t whack it cuz I thought it would stop with the owner calling it. It didnt’ and bit Odie on her ear. A small nick. The lady finally grabbed her dog by the collar and hauled it off. She was careful to wait til they moved apart first so she wouldn’t get bit by mistake.
She said next time use the stick and she apologized.
oh was 4x. I was across the street and some kids knew their dog was a fighter. A beagle. My son was walking one dog and me the other. That beagle came after brandon’s dog and I ran over and used the stick on it. The 2 kids ran over yelling I hit their dog which had a leash but they threw it to the ground and let the dog run after us across the street on purpose. Then the kid started yelling at ME. I dont’ think so. I was shaking so badly after that.
I called police and animal control. They took care of it. Their mother was furious and it never happened agian. Another time was a little chihuahua. I didn’t hit it it couldn’t do any damage.

However yes the radio station is an excellent idea. Go for it. That man was mean to do that. I am happy to hear your dear dog is ok no serious injury. Poor thing.

You know if you see him again follow him home. I did that with a new neighbor mentally challenged and had 2 chow dogs he would let the leash extend all the way so they could get in our yard. Drove my dogs nuts. me too And I was riding my bike and didn’t see the leash he was on one side of the street the dogs on the other. I rode my bike into the little leash thingy from those retractable leash things. HE got mad at ME. Well he didn’t walk those dogs anymore down my street.
